Starting <strong>January 1st, 2026<\/strong>, the CBAM (Carbon Border Adjustment Mechanism) officially enters its definitive implementation phase.<\/p>\n\n\n\n<p>For companies importing carbon-intensive goods\u2014such as iron, steel, aluminum, cement, fertilizers, hydrogen, and electricity\u2014the rules are changing drastically. Here is everything you need to know to navigate this transition securely.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The Obligation of the &#8220;Authorized CBAM Declarant&#8221;<\/h3>\n\n\n\n<p>According to Article 5 of <a href=\"https:\/\/eur-lex.europa.eu\/eli\/reg\/2023\/956\/oj\/eng\">EU Regulation 2023\/956<\/a> and recent clarifications from the Customs Authorities, importing CBAM-subject goods into the EU now requires the official status of &#8220;Authorized CBAM Declarant.&#8221;<\/p>\n\n\n\n<p>What happens without authorization?<br>Acting late or ignoring the regulations exposes your business to severe operational and financial risks:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Cargo blocks at the border.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Refusal of customs clearance by authorities.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Hefty financial penalties and administrative sanctions.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">2026 Updates: Simplifications and Derogations<\/h3>\n\n\n\n<p>Despite the strict nature of the law, the recent <a href=\"https:\/\/eur-lex.europa.eu\/eli\/reg\/2025\/2083\/oj\/eng\">EU Regulation 2025\/2083<\/a> has introduced key simplifications to support businesses during this shift.<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>&#8220;De Minimis&#8221; Exemption (50-Tonne Threshold)<br><\/strong>A significant update concerns the net mass exemption. Importers are exempt from CBAM obligations if the total net mass of all CBAM goods imported within a calendar year does not cumulatively exceed 50 tonnes.<\/li>\n<\/ol>\n\n\n\n<p>Please note: Even if exempt from purchasing certificates, starting January 1st, 2026, importers must formally declare this exemption within the relevant customs declaration.<\/p>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li><strong>Temporary Derogation: Deadline March 31st<br><\/strong>The Customs Agency has clarified a flexibility window.
