The EU Commission has published its annual proposal for updating the dual-use products list
On September 5, 2024, the European Commission approved a significant update to Annex I of Regulation (EU) 821/2021. This update establishes a control regime for the export, brokering, technical assistance, transit, and transfer of dual-use products. The amendment will be published in the Official Journal of the EU and will come into effect, unless objections are raised by the European Parliament or the Council of the EU, in accordance with Article 290, paragraph 2 of the Treaty on the Functioning of the EU. The control period will typically last two months after the adoption of the act.
The last update of the dual-use products list was based on Delegated Regulation (EU) 2023/2616 by the Commission. Keeping this list up-to-date is crucial to ensure compliance with international security obligations, promote transparency, support the competitiveness of the European Union, and facilitate consultations by regulatory authorities and economic operators.
The new delegated act introduces changes to the EU dual-use products list, altering control parameters, updating definitions and technical descriptions, as well as including or removing certain products. This ensures that regulations keep pace with global security and control needs.
